Digital Science Terms and Conditions

These Terms and Conditions ("Terms") apply to the surechem.org website (the "Site") and other SureChem products which are hosted and sold by Digital Science, a business unit of Macmillan Publishers Limited, a company registered in England under company number 00785998 with a registered office at Brunel Road, Houndmills, Basingstoke, Hampshire, RG21 6XS, United Kingdom ("we", "us", "our"). Our VAT number is GB199440621. They apply regardless of the means of delivery of the Site to you.
The Legal Notice and Privacy Policy are also incorporated here by reference.
Thank you for visiting the Site. In consideration of us making the Site and its functionality available for your use, you accept and agreed to be bound by these Terms. If you do not accept these Terms, do not use the Site. We may change these Terms from time to time, so you should review them each time that you visit the Site. You should print a copy of these Terms for future reference.
Using the Site
- Users, whether or not registered, must be over 13 years of age. If you are under 16, you must first obtain the consent of your parent or guardian to use or register with the Site.
- You may view (and, where applicable, listen to) the content and applications available on the Site for your private non-commercial use. You may print individual webpages on or download data from the Site for your private non-commercial use, provided that such printing is not substantial or systematic and our trade marks, and copyright and trade mark notices, are not removed. Unless you have our prior written permission you are not permitted to copy, broadcast, make available to the public, show or play in public, adapt or change in any way the material (or any part of it) contained on the Site for any purpose whatsoever.
- Registered users may customise some of the Site's preferences to personalise aspects of their account behaviour for their own non-commercial use. Users must not otherwise alter, adapt or reverse engineer any part of the Site.
- Unless otherwise stated in these Terms, you must not (whether directly or indirectly) (a) distribute, transmit, syndicate, sell or offer to sell or otherwise make available all or any part of the Site or any content, files, feeds or data from the Site, whether publically available or not; or (b) copy, download, or store any content, files, feeds or data from the Site, whether publically available or not, to make or populate a database or publication of any kind whatsoever, provided that for the avoidance of doubt this is not intended to restrict copying of an insubstantial part of any such material or where you are able to show "fair dealing" with it, in each case in accordance with the Copyright, Designs and Patents Act 1988.
- You must not use or allow others to access or use, all or any part of our Site or the contents and/or applications on it for commercial purposes without our permission.
- Access to the Site in an automated manner is not permitted, and may result in banning from the Site, as well as legal action. Data from the Site or any SureChem product may not be resold or redistributed. Digital Science reserves the right to ban users from the Site, whether using automated means or not, if, in our sole opinion, they are abusing our data or database.
- In the case of abuse by a customer, access to the Site or SureChem products will be terminated without any refund, either pro-rata or otherwise, of license fees paid.
- Users should be aware that content and applications may be removed from the Site with or without notice at any time and reliance on their continued availability is at the user's risk.
- To seek permission to do anything prohibited by or not contained in these Terms, or which requires our prior consent or agreement, you can contact us by emailing: sales@surechem.org.
Linking to the Site
- You may establish a link to the Site, provided that:
- the link is not detrimental to and/or does not take unfair advantage of our reputation or business;
- the link does not falsely suggest that we endorse, approve of or are associated with your website or any of its contents; and
- framing is not allowed and you must not provide access to the Site or part of it under any other URL (e.g. by domain forwarding, URL re-direction or similar).
Registration
- Only one registration per person is allowed. You must keep your registration information up to date.
- You must choose a corporate or academic email address which gives you frequent access to emails sent to that address, as we need to be able to contact you. You must keep your password confidential.
- You must not:
- impersonate or try to impersonate another person;
- disclose your password to anyone else;
- allow anyone else use to your account;
- use anyone else's account.
- You are responsible for everything done using your account, even if someone else is using your registration details without your knowledge. If you think that someone else may have access to, or be using, your password or account, you must tell us as soon as possible by emailing sales@surechem.org
- Once you register with one of our sites, you may be able to use your username and password to log into our other sites operated by Digital Science or Macmillan Publishers Ltd. If so, these Terms apply to those other sites unless otherwise stated. You should read the terms available on our other sites to check in any event.
Warranty
No warranty, explicit or implied, is made with respect to the completeness or accuracy of the data contained in the Site and Digital Science will not accept responsibility for any actual or consequential damages that may arise from the use of the Site.
Privacy Policy
Macmillan Publishing Limited, trading as "Digital Science" ("Digital Science") which distributes the SureChem suite of products ("SureChem") respects your concerns about privacy and values its relationship with you. This Privacy Notice (the "Notice") describes:
- the types of information we collect from subscribers, customers, contacts and visitors to our website at www.surechem.org;
- how we may use that information;
- with whom we may share that information; and
- the measures we take to protect the security of that information.
Our website is hosted in the US. We comply with applicable laws to safeguard your information.
Information We Collect and How We Use It
Personal Information We Collect About You
You may choose to provide personal information (such as your name, address, telephone number and email address) to us. We list below the methods by which
you may provide the information and the types of information you may submit. We also tell you how we may use the information.
Contacting Us
If you communicate with our Customer Services department through the 'Contact' page on our website or by post or telephone, we may ask you for
information such as your email address, your location, the type of product you subscribe to and/or purchase from us and the type of customer
you are (e.g. personal subscriber, free trial registrant, website visitor etc.). You may also choose to provide additional personal information,
for example, in the form of an attachment or by post. We will hold these details in our customer services query database and use such personal
information to respond to your questions and comments. We may also use such personal information to evaluate the quality of our products and services.
Registering for evaluations or subscribing
Digital Science allows visitors to sign up for or request free evaluation trials of its SureChem Web Portal product. Customers who contact our sales
department can also request evaluation trials for our Web Service and Database products. If you choose to register for or otherwise request a trial,
we may ask you to provide information such as your full name, email address, address, corporate or academic affiliation, telephone and email contact
information and the website of your organisation. We will use such personal information to provide you with the services and/or products you select
during the registration or evaluation request process. Provided you have consented, we may also use such personal information to contact you about
other services and/or products of a similar nature, that we think may be of interest to you.
Subscribing to SureChem products
On our website, you may choose to purchase a license to the SureChem Web Portal. You may also contact us directly for licensing of the SureChem Web
Service or Database products. When you choose to license our products, we may ask you to provide your full name, email address, address, corporate
or academic affiliation, telephone and email contact information, the website of your organisation, billing address and debit or credit card information
(including card type, cardholder name, card number, expiry date and security code). Such personal information is collected for the purpose of providing
you with your chosen products and/or services. We use industry-standard encryption technologies and a secure server for transferring and receiving
credit card information exchanged with our website.
Non-Personal Information We Collect
We collect certain aggregated and non-personal information when you visit our website. Aggregated and non-personal information does not relate
to a single, identifiable visitor. It tells us information such as how many users visited our website and which pages were accessed. By collecting
this information, we learn how to best tailor our website to our visitors. We collect this information either through "cookie" technology or with
"web beacons", as explained below.

Like many companies, we use "cookies" on our website(s). Cookies are bits of text that are placed on your computer's hard drive when you visit

Information We Share
We do not sell or otherwise disclose information about our website visitors or subscribers, except as described here. We may share the information you provide with affiliates of Macmillan Publishers Ltd (i.e. companies in our group). We may also share the information with service providers we have retained to perform services on our behalf. These service providers are not authorised by us to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements. In addition, we may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement agencies following an appropriate request or (iii) when we believe disclosure is necessary to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.
